By registering, placing a bid, or purchasing an item through Erkelens & Olson Auctioneers, you acknowledge that you have read, understand, and agree to these Terms & Conditions. All bids are binding, and all sales are final.
Registration & Bidding
- Registration Required: All bidders must create an account and register before placing bids.
- Secure Credit Card Verification: A temporary $0.01 authorization hold may appear on your credit card during registration to verify your payment method. This is not a charge and will automatically be released according to your financial institution's policies.
- Bidding Starts at $10: All auctions open at $10, with bid increments increasing automatically based on the current bid amount.
- Every Bid Counts: Placing a bid creates a legally binding agreement to purchase the item if you are the winning bidder.
- 2-Minute Soft Close: Any bid placed within the final 2 minutes extends that lot's closing time by 2 minutes. Bidding continues until no additional bids are received.
- Use Max Bid: Enter your maximum bid and our system will automatically bid on your behalf, increasing your bid only as needed to keep you in the lead, up to your maximum amount.
- Stay Informed: By registering, you agree to receive important auction emails, including outbid notifications, winning bid notices, invoices, pickup reminders, and upcoming auction announcements. You may unsubscribe from promotional emails at any time.
Auction Process
- Auctions are conducted online in a timed format.
- The first lot begins closing Thursday at 9:00 AM, with subsequent lots closing every 10 seconds.
- Any bid placed within the final 2 minutes extends that lot's closing time by 2 minutes.
- No in-person inspection or preview is available unless specifically announced.
- By placing a bid, you acknowledge that you have reviewed the available photos and descriptions and have had the opportunity to ask questions before bidding.
- The Auctioneer reserves the right to:
- Accept bids in increments deemed to be in the Seller's best interest.
- Reject any bid or bidder at its sole discretion.
- Add, group, divide, withdraw, or re-offer lots at any time.
- Refuse service to anyone.
- Only winning bidders may enter the auction warehouse. For safety reasons, children are not permitted.
- Please bid responsibly. If you're unsure, it's best not to bid. Once placed, bids cannot be withdrawn.
Payment
- Payment is due immediately upon receipt of your invoice.
- All purchases must be paid in full on the day of the auction.
- Accepted forms of payment: Cash or Debit/Credit Card (no processing fees).
- Invoices are automatically emailed after the auction and are also available within your bidder account.
- If payment has not been received by 3:00 PM on auction day, Erkelens & Olson Auctioneers reserves the right to charge any payment method on file.
- The Auctioneer's record of sale shall be final and conclusive.
Buyer's Premium & Sales Tax
- An 8% Buyer's Premium applies to all purchases.
- Applicable sales tax will be collected unless a valid resale or tax exemption certificate is on file prior to payment.
Catalog, Photos & Descriptions
- Catalog descriptions, photographs, stock images, and other information are provided as a guide only.
- Counts, quantities, dimensions, and descriptions are believed to be accurate but are not guaranteed.
- Colors and condition may vary from photographs.
- Errors or omissions do not relieve the Buyer of responsibility for reviewing available information before bidding.
- Announcements or updates made by the Auctioneer take precedence over any previously published material.
General Terms
- All property is sold AS IS, WHERE IS, with no warranties or guarantees, expressed or implied.
- All sales are final.
- All items sell without reserve, unless otherwise stated.
- Erkelens & Olson Auctioneers is an independent auction company and is not affiliated with or representing any manufacturer. Merchandise is sold without manufacturer representation or warranty.
- It is the Buyer's sole responsibility to determine the condition, authenticity, age, value, completeness, and suitability of each item before bidding.
- Buyers must rely solely upon their own judgment and the information provided.
Removal & Pickup
- Purchased items become the Buyer's responsibility immediately upon the close of the auction.
- Buyers are responsible for removing all purchases during the posted pickup days and hours.
- A paid invoice is required before merchandise will be released.
- Purchases not removed by the posted deadline may be considered abandoned, forfeited without refund, and resold or otherwise disposed of at the Auctioneer's discretion.
- Erkelens & Olson Auctioneers assumes no responsibility for loss, theft, or damage to items not removed by the stated deadline.
- Pallet jacks and forklifts may be available to assist with loading; however, such assistance does not transfer responsibility or liability to Erkelens & Olson Auctioneers or its staff.
- Pallets remaining after the Monday following the auction will incur a $25 per pallet, per day storage fee.
- Wire bins remain the property of Erkelens & Olson Auctioneers and may not be removed.
- Staff will be available to help facilitate an orderly pickup process but are not responsible for loading or securing purchased items.
Shipping
- Local and nationwide shipping is available on eligible items.
- Please review the Shipping tab on each lot before bidding to determine shipping eligibility and available options.
Restricted Items
Certain items may not legally be resold or may be subject to recovery if requested. Examples include, but are not limited to:
- Firearms and weapons
- Illegal drugs
- Government-issued identification
- Privacy-sensitive materials
- Alcohol and tobacco products
- Aviation parts
- Military or government property
- Prototype products
- Certain industrial electronics
- Original artwork
- Other items not intended for public resale
If recovery is required, the Buyer must return the item upon request and will be reimbursed up to the original purchase price. Buyers may not sell recovered items back to the original manufacturer.
Counterfeit Disclaimer
- Every reasonable effort is made to identify and remove counterfeit merchandise; however, no guarantee of authenticity is expressed or implied.
- If a Buyer believes an item may be counterfeit, they must notify staff before leaving the premises.
- Suspected counterfeit items will be retained or destroyed as required. No refunds, credits, or adjustments will be made after removal from the premises.
